    Disclaimer of warranty

To the maximum extent permitted by applicable law, the aggregate liability of Infusion Church and its affiliates, officers, employees, agents, suppliers and licensors relating to the services will be limited to an amount no greater than one dollar or any amounts actually paid in cash by you to Infusion Church for the prior one month period prior to the first event or occurrence giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.

    Indemnification

    You agree to indemnify and hold Infusion Church and its affiliates, directors, officers, employees, agents, suppliers and licensors harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys’ fees, incurred in connection with or arising from any third party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Website and Services or any willful misconduct on your part.

    Severability

The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in California, United States, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

    Assignment

    You may not assign, resell, sub-license or otherwise transfer or delegate any of your rights or obligations hereunder, in whole or in part, without our prior written consent, which consent shall be at our own sole discretion and without obligation; any such assignment or transfer shall be null and void. We are free to assign any of its rights or obligations hereunder, in whole or in part, to any third party as part of the sale of all or substantially all of its assets or stock or as part of a merger.

    Changes and amendments

    We reserve the right to modify this Agreement or its terms related to the Website and Services at any time at our discretion.   • By attending this school, you understand and release any liabilities and give us authorization to take photos & videos while and during school classes and events both online and in person and recognize that your photo may at some point be used and posted but not limited for marketing/social media/advertising purposes.

  • You acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that you may be exposed to or infected by COVID-19 by attending the Church/School event and that such exposure or infection may result in personal injury, illness, permanent disability, and death. You understand that the risk of becoming exposed to or infected by COVID-19 at the Church/School facility/grounds or this event may result from actions, omissions, or negligence of myself and others, including but not limited to voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury or illness to yourself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind that you may experience or incur in connection with your attendance at this Church or participating in Church/Ministry School programming (“Claims”).

    You hereby release, covenant not to sue, discharge, and hold harmless Psalm84 Church / Infusion Church/ Infusion Supernatural Ministry School / 32 Century oaks court Homeowner/ Parkway Fellowship or their Facilities, properties, employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of relating thereto. You understand and agree that this release includes any claims by or on the actions, omissions, or negligence of Psalm84 Church / Infusion Church/ Infusion Supernatural Ministry School / Parkway Fellowship / 32 Century oaks court homeowner, its employees, agents, representatives, whether a COVID-19 infection occurs before, during or after participation in any of our Church/Ministry School program and/or event.
